Tenancy deposits and repairs: documents, notices and evidence

Housing disputes are highly document-dependent. The tenancy, deposit records, prescribed information, inventory, photographs, repair reports, notices and correspondence should be placed in a dated sequence before any formal letter or application is prepared.

Identify the tenancy and property

Record the parties, property, start date, fixed or periodic term, rent, deposit, permitted occupiers and relevant clauses. Keep every renewal, variation, inventory and check-in record.

Separate deposit and repair issues

A deposit-protection complaint, a proposed deduction and a disrepair complaint may involve different facts, documents and procedures. Do not combine them without explaining each route separately.

Create a dated evidence file

Photographs should have dates and context. Repair requests should show what was reported, when, to whom and what response followed. Receipts, inspection reports and contractor records should be linked to the specific condition alleged.

State the requested outcome

A letter should specify the repair, access arrangement, information, payment, return of deposit or response required. A vague demand makes it difficult to assess compliance.

Before using a court, deposit scheme, council or ombudsman route, verify eligibility, preconditions, time limits, forms, fees and evidence requirements from the current official source.
